Terms of Service for Spireknight

These Terms of Service (“Terms”) are a legal agreement between you and Iron Skull Studios (“we,” “us,” or “our”) governing your use of the mobile game Spireknight (the “Game”). By downloading, installing, or playing the Game, you agree to these Terms. If you do not agree, do not use the Game.

1. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the Game on devices you own or control, solely for your personal, non-commercial entertainment, and subject to these Terms and the rules of the app store you downloaded it from.

2. Eligibility

You must be old enough to form a binding contract in your jurisdiction, or have the consent of a parent or legal guardian.

3. Your account and identifier

The Game does not require a traditional account. It identifies your progress using an anonymous identifier stored on your device (see our Privacy Policy). You are responsible for activity that occurs through your device.

4. Virtual items and in-game currency

The Game may include virtual currencies, items, gear, and rewards (“Virtual Items”). Virtual Items:

• Have no monetary value and are not real currency or property.
• Are licensed to you, not sold, and are non-transferable and non-refundable except where required by law.
• May be modified, managed, or removed by us at any time, and may be lost if you delete the Game or your local data.

5. Acceptable use

You agree not to:

• Cheat, exploit bugs, use unauthorized third-party software, bots, or modify the Game to gain an unfair advantage.
• Reverse engineer, decompile, or attempt to extract source code except as permitted by law.
• Interfere with or disrupt the Game’s servers or networks.
• Enter offensive, unlawful, infringing, or personally identifying content as a display name.

6. User-provided content

If you enter a display name or other content, you grant us a worldwide, royalty-free license to display it within the Game for the purpose of operating the Game.

7. Intellectual property

The Game and all of its content — including code, artwork, characters, logos, music, and text — are owned by us or our licensors and are protected by intellectual-property laws. “Spireknight” and associated logos are our marks and may not be used without permission.

8. Updates and availability

We may update, change, suspend, or discontinue the Game or any feature at any time, with or without notice.

9. Disclaimers

The Game is provided “as is” and “as available,” without warranties of any kind, whether express or implied.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, progress, Virtual Items, profits, or goodwill, arising out of or relating to your use of the Game. Our total liability will not exceed the greater of the amount you paid us for the Game in the twelve months before the claim, or USD $10.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your misuse of the Game or violation of these Terms.

12. Termination

These Terms remain in effect while you use the Game. We may suspend or terminate your access at any time for any reason. You may stop using the Game at any time by uninstalling it.

13. Third-party stores

Your download and use of the Game is also subject to the terms of the app store you obtained it from. Apple and Google are not responsible for the Game or its content.

14. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules.

15. Changes to these Terms

We may revise these Terms from time to time. Your continued use of the Game after changes take effect constitutes acceptance of the revised Terms.
